Hearing Accessibility Laws & Standards

A practical overview of the main federal duties, ADA design requirements, technical criteria and local-code considerations affecting hearing access in public-facing venues across the United States.

Important: federal ADA requirements are only part of the compliance picture. State and local building codes may add or differ in their accessibility provisions, and project-specific duties depend on the entity, facility, work performed, communication context and date.

Who and what is covered

The ADA requires state and local governments and most businesses and nonprofit organisations that serve the public to communicate effectively with people who have hearing, vision or speech disabilities. When needed, covered entities must provide appropriate auxiliary aids and services, which can include assistive listening systems and devices, captioning, interpreters and other communication supports.

ADA Title II

Covers services, programs and activities of state and local governments.

ADA Title III

Covers most businesses and nonprofit organisations that serve the public.

Section 504

Applies to programs or activities receiving federal financial assistance.

State and local rules

Building codes and disability laws can create additional requirements.

Religious organisations are generally exempt from ADA Title III, but a religious venue may still have duties under state or local law, building codes, funding conditions or other rules. Confirm the requirements that apply to the specific facility.

Public entities must ensure effective communication and provide appropriate auxiliary aids and services when necessary. The requested aid receives primary consideration, although an equally effective alternative may sometimes be used.

2010 ADA Standards — Section 219

Sets scoping requirements for assistive listening systems in assembly areas and establishes the minimum receiver quantities.

Applies to covered new construction and alterations under the relevant ADA standards.

State and local building codes

Thousands of U.S. code jurisdictions enforce state or local accessibility requirements. Following a local code does not by itself establish ADA compliance unless the requirements meet or exceed the ADA.

Check the adopted code, amendments and enforcing authority for the project location.

Assistive listening system requirements

Under Section 219, each assembly area where audible communication is integral to the use of the space must provide an assistive listening system. Except for courtrooms, the requirement does not apply where audio amplification is not provided.

Minimum receivers under ADA Table 219.3

50 seats or fewer

2 receivers

2 must be hearing-aid compatible.

51–200 seats

2 receivers, plus 1 per 25 seats over 50, or fraction thereof.

2 must be hearing-aid compatible.

201–500 seats

2 receivers, plus 1 per 25 seats over 50, or fraction thereof.

1 per 4 receivers, or fraction thereof, must be hearing-aid compatible.

501–1,000 seats

20 receivers, plus 1 per 33 seats over 500, or fraction thereof.

1 per 4 receivers, or fraction thereof, must be hearing-aid compatible.

1,001–2,000 seats

35 receivers, plus 1 per 50 seats over 1,000, or fraction thereof.

1 per 4 receivers, or fraction thereof, must be hearing-aid compatible.

2,001 seats and over

55 receivers, plus 1 per 100 seats over 2,000, or fraction thereof.

1 per 4 receivers, or fraction thereof, must be hearing-aid compatible.
Hearing-aid compatibility: at least 25% of required receivers, but no fewer than two, must be hearing-aid compatible. Where every seat is served by an induction-loop system, Section 219.3 provides an exception from the minimum number of hearing-aid-compatible receivers, although other required receivers may still apply.

Availability signs

Covered assembly areas must display the International Symbol of Access for Hearing Loss to tell patrons that assistive listening systems are available. A ticket-office exception may apply.

Receiver connection

Required receivers must include a standard 1/8-inch mono jack. Hearing-aid-compatible receivers must interface with telecoils through neckloops.

Output level

Systems must be capable of 110 dB minimum and 118 dB maximum sound pressure level, with a 50 dB volume-control dynamic range.

Signal quality

Internally generated signal-to-noise ratio must be at least 18 dB, and peak clipping must not exceed 18 dB relative to speech peaks.

What this means for venues

Start by identifying the legal status of the operator, the communication activities in each space, whether amplification is provided, the seating capacity, the project type and the adopted state or local code. Then document the complete user journey: discovering the service, requesting equipment, receiving it, using it and returning it.

Confirm scope

Determine which federal, state and local rules apply to the operator and facility.

Specify performance

Verify coverage, receiver counts, hearing-aid compatibility and Section 706 performance.

Make access visible

Provide compliant signs and a clear process for requesting and receiving equipment.

Operate and test

Train staff, keep devices charged and sanitary, and test the system routinely.

The 2010 ADA design standards and the ADA effective-communication rules answer different questions. A venue may need to evaluate both the physical-system requirements and whether communication is actually effective for the individual and situation.

Technologies commonly used

The ADA standards describe assistive listening systems by function and performance. The appropriate transmission method depends on the space, privacy, coverage, interference, user devices and required receiver arrangements.

Auracast is an emerging hearing-access option, but it is not named in the 2010 ADA Standards. Using it does not by itself prove compliance with Sections 219 and 706, receiver availability, hearing-aid compatibility, signage or effective-communication duties. Evaluate it as part of the complete accessibility solution.
